Fairfax man charged after woman killed in accidental shooting

A Fairfax man has been charged after accidentally firing a gun inside a Legato residence, killing a woman.

Richard Huynh, 31, was apparently securing his firearm in a gun box on the third floor of a home on Friday (Sept. 26) when the weapon discharged, the Fairfax County Police Department says.

The fired bullet traveled through the floor of a home in the 4500 block of Derring Lane and struck 30-year-old Jennifer Kim, who was on the second level, around 3:35 p.m., according to police.

Huynh and responding officers rendered first aid before Kim was transported to a local hospital, but she was later pronounced dead.

Huynh was arrested and charged with one count of unlawful discharge of a firearm, a felony that carries a maximum penalty of five years in prison.

At this time, Huynh doesn’t face any charge specifically for Kim’s death, such as murder or malicious wounding. There is nothing preventing prosecutors from seeking additional charges in the near future.

According to online court records, Huynh is scheduled to appear for a preliminary hearing in Fairfax County General District Court on Dec. 23. At that time, a judge will determine if there is probably cause for the case to go before a grand jury.
