Years of work to redevelop the core of downtown Herndon have officially fizzled out.

Developer Comstock informed town leaders last Friday (Dec. 6) that it will no longer move forward with a long-awaited project that promised apartments, retail, an arts center and a public parking garage, interim town manager Chris Martinez announced at the Herndon Town Council meeting tonight (Tuesday).

Herndon leaders indicated this week that they’re confident enough in the town’s financial reputation to put it on the line for the sake of Comstock’s long-awaited downtown redevelopment project.

As discussions continue on a new agreement with the developer that must be finalized by Dec. 10, the town is starting to hammer out a financing plan for the public portions of the project that could involve borrowing money through the issuance of municipal bonds.

Dozens of Kimley-Horn and Associates employees experienced health issues after being exposed to toxic gases in the Reston Station office where they worked, the North Carolina-based engineering firm alleges in a recent court filing.

Kimley-Horn shared the allegations on Nov. 6 in response to a lawsuit filed in October by landlord and Reston Station developer Comstock, which is accusing its tenant of underpaying rent for the three suites it leases at 11400 Commerce Park Drive.

The developer Comstock is suing the engineering firm Kimley-Horn and Associates for allegedly underpaying rent for its Reston Station office.

In a complaint filed with the U.S. District Court in Alexandria on Oct. 11, Comstock asserts that its tenant paid only half of the rent that it owes this month for space at 11400 Commerce Park Drive.

The Herndon Town Council has once again deferred finalizing an agreement with developer Comstock to redevelop downtown Herndon — a move met with an ire and skepticism that has steadily grown after years of delays.

The council voted 5-1 last night (Tuesday) to extend a deadline for signing an amended agreement with the developer to Dec. 10. The deadline — known as the “outside satisfaction date” — had already been pushed back from April 30 and again from Aug. 15 following a two-year pause on the project.

For the first time in years, the developer has a potential timeline for its long-delayed downtown Herndon redevelopment that it’s optimistic might actually hold — news greeted by community members with a mix of guarded hope and skepticism.

After a well-attended, sometimes emotional public hearing, the Herndon Town Council voted unanimously last night (Tuesday) to push back the “outside satisfaction date” to finalize an amended agreement with the developer from tomorrow (Thursday) to Sept. 10.
